ADULT PARTICIPANT ASSUMPTION OF RISK,
RELEASE OF LIABILITY,
AND COVENANT NOT TO SUE

READ THIS AGREEMENT CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. BY SIGNING OR ELECTRONICALLY ACCEPTING IT, YOU ARE RELEASING CLAIMS, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES, TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW.

This Adult Participant Agreement (“Agreement”) is entered into by the individual participant identified below (“Participant”) in consideration of being permitted to attend or participate in a tour provided, arranged, or coordinated by Tastes and Tales Food Tours, LLC, a Florida limited liability company (the “Company”). Each adult participant must accept this Agreement individually. A ticket purchaser may not accept this Agreement for another adult unless legally authorized to do so.

For purposes of this Agreement, “Tour Activities” include the guided walking tour; travel on foot between stops; entry into restaurants, shops, and other third-party locations; food and beverage tastings; optional alcohol tastings where lawfully offered; any related demonstrations or activities; and, if offered, transportation in a golf cart, trolley, shuttle, automobile, or other vehicle, including boarding and exiting. “Released Parties” means the Company and its current and former members, owners, managers, officers, employees, tour guides, agents, independent contractors, affiliates, successors, assigns, and insurers.

1. Voluntary Participation; Age; Physical Ability

I represent that I am at least 18 years old and am voluntarily participating in the Tour Activities. I understand that the Tour may require extended standing and walking, navigating curbs, stairs, uneven surfaces, and crowded public areas, and entering and exiting vehicles if transportation is offered. I am responsible for deciding whether I can safely participate, for using any mobility aid I require, and for stopping or requesting assistance if I believe continuing would be unsafe. I will follow reasonable safety instructions provided by the Company, its guides, and any venue or transportation provider.

2. Acknowledgment and Assumption of Risks

I understand that the Tour Activities involve known and unknown risks that may cause property damage, illness, bodily injury, disability, or death. These risks include, without limitation:

Walking and public-area risks: uneven pavement, curbs, stairs, wet or slippery surfaces, potholes, construction, low lighting, crowds, traffic, street crossings, bicycles, scooters, animals, falling objects, and the acts of other persons.

Weather and environmental risks: heat, humidity, sun exposure, rain, wind, lightning, poor air quality, insects, and other changing outdoor conditions.

Food and beverage risks: allergic or adverse reactions, cross-contact with allergens, choking, foodborne illness, contamination, unexpected ingredients, improper preparation or storage, and aggravation of a medical condition.

Alcohol-related risks: impaired judgment, balance, coordination, or reaction time; falls; interactions with medications or medical conditions; and the acts of other persons who may have consumed alcohol.

Third-party-location risks: conditions, products, services, employees, patrons, security, sanitation, and operations at restaurants, shops, venues, sidewalks, parking areas, and other locations not controlled by the Company.

Transportation risks, if transportation is offered: boarding or exiting; sudden stops or turns; collisions; driver error; acts of other motorists; road, traffic, or weather conditions; inadequate or unavailable restraints; and mechanical or equipment failure.

Other risks: delayed or unavailable emergency assistance; exposure to communicable illness; loss, theft, or damage to personal property; and risks arising from my own condition, conduct, or failure to follow instructions.

I KNOWINGLY AND VOLUNTARILY ASSUME THE RISKS OF THE TOUR ACTIVITIES, INCLUDING RISKS ARISING FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY, TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW.

3. Food Allergies, Dietary Restrictions, and Food Safety

I am responsible for informing the Company at booking and the tour guide before consuming food or beverages about any allergy, intolerance, dietary restriction, or other relevant condition. I understand that the Company and participating venues cannot guarantee an allergen-free environment, prevent cross-contact, verify every ingredient, or accommodate every dietary need. Recipes, ingredients, suppliers, and preparation methods may change without notice. I will ask the venue directly when I need ingredient or preparation information, will not consume an item if I am uncertain it is safe for me, and will carry any medication or emergency treatment I may require. I assume the risks associated with my food and beverage choices.

4. Alcohol Policy (Age 21 and Older Only)

Alcohol tasting is optional. I will not consume alcohol unless I am at least 21 years old and can present valid government-issued identification upon request. I will not obtain or share alcohol for a person under 21. I am solely responsible for deciding whether and how much to consume, considering my health, medications, tolerance, and transportation plans. I will not drive while impaired and will arrange safe transportation after the Tour when needed. The Company may refuse or stop alcohol service, deny participation, or remove a participant without refund for apparent intoxication, impairment, unsafe conduct, or disruption.

5. Transportation, If Offered

Transportation may be operated by the Company, an independent contractor, or a separate third-party provider. I will follow the driver’s instructions, use an available seat belt or other restraint, remain seated when directed, keep my body and belongings within the vehicle, and promptly report any condition I believe is unsafe. I understand that the Company does not control the independent operations of an unrelated third-party transportation provider. This Agreement releases claims against the Released Parties, including claims concerning the Company’s alleged ordinary negligence in selecting, arranging, coordinating, or providing transportation, but it does not release an unrelated third-party provider unless that provider is separately and clearly identified as a released party in the applicable booking or waiver materials.

6. Third-Party Establishments and Changes to the Tour

Restaurants, shops, venues, property owners, and unrelated transportation providers are independent businesses that control their own premises, employees, food preparation, products, vehicles, and operations. The Company does not guarantee their services, ingredients, sanitation practices, security, accessibility, or continued availability. Tour routes, stops, menus, timing, and activities may be changed or canceled because of availability, weather, safety, traffic, venue decisions, or other circumstances.

7. RELEASE OF LIABILITY AND COVENANT NOT TO SUE

TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, I, FOR MYSELF AND MY ESTATE, HEIRS, PERSONAL REPRESENTATIVES, AND ASSIGNS, RELEASE AND FOREVER DISCHARGE THE RELEASED PARTIES FROM ALL CLAIMS, DEMANDS, DAMAGES, LOSSES, LIABILITIES, ACTIONS, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THE TOUR ACTIVITIES, INCLUDING CLAIMS FOR PERSONAL INJURY, DEATH, ILLNESS, ALLERGIC REACTION, FOODBORNE ILLNESS, EMOTIONAL DISTRESS, OR LOSS OF OR DAMAGE TO PROPERTY.

THIS RELEASE EXPRESSLY INCLUDES CLAIMS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY, WHETHER ACTIVE OR PASSIVE, INCLUDING ALLEGED NEGLIGENCE IN PLANNING OR CONDUCTING THE TOUR; SELECTING OR COORDINATING ROUTES, STOPS, VENUES, OR TRANSPORTATION; PROVIDING INSTRUCTIONS OR WARNINGS; SUPERVISING PARTICIPANTS; MAINTAINING OR OPERATING EQUIPMENT OR VEHICLES; OR RESPONDING TO AN INCIDENT.

I COVENANT NOT TO SUE A RELEASED PARTY FOR A CLAIM COVERED BY THIS RELEASE.

This section does not release claims based on gross negligence, reckless or intentional misconduct, or any other liability that cannot lawfully be waived.

8. Limited Indemnity for Participant Conduct

To the fullest extent permitted by law, I will indemnify, defend, and hold the Released Parties harmless from third-party claims, damages, costs, and reasonable attorneys’ fees arising from my own negligent or wrongful conduct; violation of law or Tour rules; damage I cause to property; or material misrepresentation in connection with the Tour. This obligation does not apply to the extent a claim is caused by the negligence or greater fault of a Released Party and does not require me to reimburse a Released Party for my own personal-injury claim, which is addressed by the release above.

9. Emergency Assistance and Personal Property

If Company personnel reasonably believe emergency assistance is appropriate, I authorize them to contact emergency services and to provide or arrange reasonable first aid or assistance, but I understand they are not medical providers and do not undertake a duty to provide medical care. I am responsible for related medical, transportation, and other costs. I am responsible for safeguarding my personal property, and the Company is not responsible for loss, theft, or damage except to the extent liability cannot lawfully be waived.

10. Participant Conduct and Removal

I will remain reasonably attentive to the guide, follow safety and venue instructions, behave respectfully, and avoid conduct that threatens or disrupts others. The Company may deny or end my participation without refund if it reasonably determines that I am intoxicated, impaired, unsafe, disruptive, abusive, or unwilling to follow instructions.

11. Minors

This Agreement applies only to the adult Participant who accepts it and does not waive any claim belonging to a minor. A person under 18 may participate only if permitted by the Company, accompanied as required by the Company, and covered by a separate waiver executed by the minor’s natural guardian that complies with Florida law. An accompanying adult who is not the minor’s natural guardian may not sign the minor’s waiver unless otherwise legally authorized. No person under 21 may consume alcohol.

12. Optional Photo and Media Consent

This choice is optional and is not a condition of participation. If no option is selected, the Company will treat that as no consent for intentional use of my identifiable image or voice in Company marketing.

I authorize the Company to photograph or record me during the Tour and to use my identifiable image, likeness, or voice for lawful advertising, website, social-media, and promotional purposes without compensation. I may revoke consent for future uses by written notice, but revocation will not require withdrawal of material already published or distributed.

NO – I do not authorize the Company to intentionally use my identifiable image, likeness, or voice in Company marketing. I understand the Company will take reasonable steps to honor this choice, although incidental background capture in public places may occur.

13. Governing Law; Venue; Severability; Entire Agreement

Florida law governs this Agreement. Any action relating to this Agreement or the Tour must be brought in a state court located in Citrus County, Florida, or, if federal jurisdiction exists, in the federal court having jurisdiction over Citrus County. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. This Agreement is the complete agreement concerning the subjects it addresses and may be modified only in a written or electronic record accepted by the Participant and the Company. Electronic signatures and electronic records have the same effect as paper originals to the extent permitted by law. The release, covenant not to sue, indemnity, and governing-law provisions survive completion of the Tour.

14. Acknowledgment and Signature

I ACKNOWLEDGE THAT I HAVE READ THIS ENTIRE AGREEMENT, UNDERSTAND THAT IT INCLUDES AN ASSUMPTION OF RISK AND A RELEASE OF CLAIMS FOR THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES, HAVE HAD THE OPPORTUNITY TO ASK QUESTIONS, AND ACCEPT IT KNOWINGLY AND VOLUNTARILY. I AM NOT RELYING ON ANY ORAL STATEMENT THAT CONTRADICTS THIS AGREEMENT.
